days are getting shorter. a slight offshore component. highs, 70s to a few upper 70s. maybe a smattering, a few 80s. here's sal. steve, good morning doing you. we're looking pretty good on this monday. this is columbus day. some people are honoring that and they are not going to work or school today. look at the bay bridge. it certainly does look like we have a little bit of a light day going and, of course, the trains are running. you've been hearing that. that's also helping us out. tomorrow could be much different, if the trains are not different and most people will be back at work and school. this is 8 -- this is 880. columbus day is not like memorial day or labor day where the freeways are empty. i don't want to mislead you. i want to mention the peninsula and the south bay. the traffic in the south bay is looking pretty good. we don't have any crashes to report. but some slowing on 101.

7:03. back to the desk. >> thank you, sal. it came down to the wire again. once again, the b.a.r.t. strike has been delayed. this time for at least one day after a marathon negotiating session. ktvu's tara moriarty joins us live now to tell us what happened yesterday, including why both sides might not be at the table today. tara? >> reporter: well, union leaders emerged here from the caltrans headquarters around 2:45 this morning. they were tired and, of course, frustrated. they've agreed to extend one more day to avoid the strike. they are angry because they say b.a.r.t. management yanked the offer when they were close to a deal gave a best, final offer. despite the gag order, b.a.r.t. management announced the deal that gives employees a 3% pay raids per year for four years. it requires them to make a 4% contribution to pension and a nearly 10% medical contribution.

>> we've been at this negotiation since april 1st. tonight, i gave a last, best and final offer to the unions on behalf of the board. gave it to them at 4:00 p.m. today which gave them ample time to ask questions. >> when we question them to ask them to be sure what that last offer meant, they indicated yes, it did and there was nothing to discuss. >> reporter: state lawmakers are not pleased that b.a.r.t. has said this is the final offer. many of them came here last night to see what was going on behind closed doors. now, while they are happy a vehicle was avoided for today, they -- strike was avoided today, they are far apart. at midnight, workers could go on strike. both sides are supposed to reconvene at 10:30 but no word whether b.a.r.t. management plans to attend. we're live in oakland, tara moriarty, ktvu channel 2 news. >> thank you, tara. well, if there is a b.a.r.t. strike tomorrow, b.a.r.t. will offer limited bus service to the transbay terminal in san francisco. but commuters who are not going

to san francisco may have a tough time getting around. county connection will run a small number of buses between the concord b.a.r.t. station and the uptown oakland transit center. wheels is planning to run buses between the dublin pleasanton transbation and an undetermined east bay hub. b.a.r.t. will charter 200 buses for the evening and morning commutes. comauters can catch -- communitiers can catch a bus at nine east bay bus station, including el cerrito, west oakland, concord, la fayette, dublin, pleasanton, san leandro, hayward and fremont. >> actually, hitchhiking, yes. >> reporter: are you serious? >> yes. no lie . i was hitch liking to work. >> reporter: officials say the best advice might be to carpool or ideally telecommute. and if b.a.r.t. strikes, a.c. transit will increase service. bus stops inside b.a.r.t. stations would be moved to the streets outside of the stations

out of san francisco where police are looking for the suspect of a deadly shooting. these are some live pictures from the scene right now. this happened just a few hours ago on 21st and bartlett streets. police say witnesses reported hearing four to five gunshots. when police arrive, they found a man face down in the street. police are now trying to figure out who shot him. we're looking live at the scene as a police officer looking at some of the evidence on the street there. anyone who may have witnessed the shooting is asked to call police. ktvu reporter katie utehs will have a live report coming up at 7:30. a 2.5 earthquake was reported this morning in the bay area. it was centered about five and a half miles northeast of milpitas. no reports of any damage. if you felt anything, you can let us know on twitter or facebook. today, san francisco mayor ed lee is scheduled to head to china. his aides tell the "chronicle" it's a business trip aimed at

attracting chinese business to san francisco. mayor quan is flying to china to talk about investors about opportunities. the potential of the b.a.r.t. strike could force both mayors to postpone their trip. this would be mayor quan's fifth stripe overseas since taking office. the "chronicle" reports that mayor quan has billed the city for 21 of her trips, a cost of $31,000. her travels have been tied to a whole lot of money coming into oakland, including tens of millions of dollars for the port and city crime-fighting efforts. while they are in china, they plan to attend the warriors game. they are there for the nba global games. coming up at 7:23, we'll tell you why one more teammate says it could be a bad thing for the warriors' season. happening right now, the annual half moon bay pumpkin

weighoff has begun. janine de la vega is there where the top contenders are hoping to squash a newly new world. janine, good morning. >> reporter: yes. the pumpkin weighoff is about to begin. it's the 39th annual safeway world championship pumpkin weighoff. they have a big scale there waiting and pumpkins are lining up, basically they are lined up, they've hauled them up on the back of the trucks, using forklifts. you can see some local people are already starting to set up chairs because they want to watch this pumpkin weighoff. i want to show you two of the biggest contenders here for the heaviest pumpkin. these are atlantic giant pumpkins. to get a little bit more information about pumpkin and pumpkin growings, we go to john hockly. now, you don't have any pumpkins in this competition but you won last year -- you got third place, right? >> yes, i did. >> reporter: okay.

what can you tell me about growing these? how long does it take and you start growing them in the cool air? >> most of us started them in a cooler. maybe 85 degrees. it depends who you talk to. within a week, they are ready to go in the ground. they are just amazing. these pumpkins are probably about 100 days old. the plant grows for about a couple of months. once you pollinate, it's a hundred days old is all. >> reporter: it's pretty dense, i mean, just wondering, i mean, how heavy do you think these are? i know it's just a guess. >> i would say that this one is gonna be mid 19s, maybe 2, we're hoping. at the peak of the season, they probably grow -- this one probably grew 40 pounds a day, i would guess. >> reporter: you are very proud -- i notice on your jacket, you have -- you won, 1600-pound club. it seems like it's a community of pumpkin growers.

and thrive. a 72-year-old hunter who spent 19 days lost in the mendocino national forest is

speaking out about the ordeal. gene penaflor said he was hunting with a friend last month when he stepped into a crevice in heavy fog. he survived by eating a snake, lizards and squirrels and covering himself with leaves. family members say they never lost hope. >> 19 days, i know was nothing for him. i knew he was there. >> penaflor kept a camp fire around the clock as a signal to rescue crews but it was never stopped. a hunter found him over the weekend. he's being reunited with family. we're following some breaking news out of london this morning. police have arrested a man with a knife who they say tried to enter buckingham palace. police found the knife during a search. he was arrested on suspicion of trespassing on a protected site and potential of an 0 offensive weapon. in september, police arrested two men of a suspected break-in at buckingham palace in what was considered a rare breach of

security. today is day 14 of the partial government shutdown with a new deadline looming this week. jamie dupree joins us from washington, d.c., where congress is facing additional pressure to raise the debt ceiling by thursday. now, jamie, things seemed so promising at the end of this past week. what caused things to break down over the weekend? >> reporter: i don't know things were promising. i have to say as i head news organizations and a lot of people talking and the markets going up, we looked at each other and said where are they getting this talk that we're about to have a deal? yes, we did have some discussions at the white house on thursday and friday but lost in all of that was the fact there was no deal making, really, there was no eye to eye kind of agreement from either party. so that rumbled through the weekend. house republicans tried last week, they met with the president. their negotiations didn't go anywhere. now we're focused more on senate democrats and republicans. so far their negotiations haven't gone anywhere.

here we are on this columbus day which in a sense is almost like a day off anyway in washington, d.c. because it's a federal holiday. and i don't sense in the halls of the congress today any momentum, any urgency. i guess -- you mentioned the thursday deadline on the debt limit. probably what will happen we'll go up to the deadline, work all night on wednesday and see where we come out in this game of legislative chicken. >> you think there are so many dire warnings all over the world. christine lagard was saying this could be a disaster for the international economy. we've had the dire situations like the sequester cuts that have come and gone and things have kept going. do you think there's a chance? >> reporter: i was gonna make that exact point. i'm not gonna try to -- i'm not gonna say people warn there could be dire finance am consequences that they are not -- financial consequences that they are not right. we've never done that before, we don't have any idea. i think there are a lot of republicans who are worried. on the other hand, there are a

lot of republicans that remember all of the dire warnings about sequestration and more that did not seem to come to pass and i think that's only fueled their sort of argument that the administration is bluffing. regardless, we have this thursday deadline. i guess the one thing i would look for, tori, is this -- if the markets really do go into a tail spin, the congress will listen. while the dow futures have been down, the world markets weren't really bad or anything like that overnight. they were up in many places. so that would tell me that not much will happen today. we'll have to see what happens as the week goes by. but certainly, if the markets were to drop -- i'm to the talking about a couple hundred points -- i'm talking a thousand points or more, then they might get the messable. but frankly -- message. but frankly, both sides are involved in retractible issues. >> thank you, jamie. you can find a link to jamie's insider blog at ktvu.com. click on politics under the

4:00 a.m. we have you covered. 880 traffic in hayward is getting slower heading south. back to the desk. >> thank you, sal. we're following developing news out of san francisco this morning, where the search is on for a gunman of a deadly shooting. ktvu channel 2 reporter katie utehs is live at the scene with more on the questions police still have in their investigation. good morning, katie. >> reporter: good morning, brian. police removed the victim's body about a half-hour ago. now detectives continue to scour this area for evidence. it may be about now hour or so between bartette between 21st and 22nd is eopenned -- is reopened. we know the victim is a man. the call came around 4:30 a.m. that four or five shots were fired. police arrived on the scene and performed cpr. the man did die on scene. neighbors say they didn't witness the shooting but hearing the gunshots is common. >> i grew up in the

neighborhood. so this is -- it's been happening a while. >> reporter: the shooting happened near a construction site. workers are waiting for police to clear the scene which may be another hour or so. now, there are lieutenants and detectives on scene but i was just told that they are waiting to release more information until a public information officer can be sent to the scene. we have been told at this point, there are no witnesses or any suspect descriptions. so we do know a male victim died of gunshot wounds but at this point, police still searching for a suspect. live in san francisco, katie utehs, ktvu channel 2 news. this morning, richmond police are investigating a deadly shooting. police say at 5:30 last night, shots were exchanged between two cars. one of those cars crashed a few blocks away on ohio and south 7th streets. police say the driver of that car dried at the -- died at the scene. we have calls in for a suspect

and vehicle information, but have not heard back. b.a.r.t. trains are running today but workers could still go on strike tonight if a deal is not reached by midnight. >> i think it's ridiculous. it's very inconvenient. i got up really early this morning, not sure if i was taking a ferry or b.a.r.t. >> that's left riders scrambling to find other ways to get to work just in case. ktvu channel 2 reporter cara lui is live at the pleasant hill b.a.r.t. station where riders are fed up. good morning, cara. >> reporter: good morning. you can feel some tension out here. a lot of people tell us they are very anxious not knowing whether they will be able to rely on b.a.r.t. to get to work tomorrow. we've heard a lot of opinions, as well as mixed reaction both from social media and here during the morning commute. some, sick and tired of the possibility of another strike. not sure if they should make alternate plans. one woman said she supports the workers even if there's another

walkout. but many, many people tell us they hope another strike can be avoided. >> it would be nice for them not to shout down. it really affects the bay area. >> i'm not a bay area. i'm hoping it gets settled by the time i get back. >> reporter: a b.a.r.t. spokesperson says ridership was down on friday by more than 20,000 passengers. a worker tells me between the holiday and some people having made alternate plans to get to work for today, traffic does seem a bit slower than usual. we're live at the pleasant hill b.a.r.t. station, cara lui, ktvu channel 2 news. >> thank you. 7:35. in case of a strike, b.a.r.t. says says some managers could operate some trains but only as a last resort. a b.a.r.t. spokeswoman said that would only happen if a strike goes on for a long period of time and it would require board approval. there are about a dozen managers who are trained to operate trains. union officials say that plan

would endanger passenger safety. in the meantime, a martinez man is so frustrated by the threat of a strike, he's been picketing outside of the negotiations. >> we're being basically held hostage by the unions at this point, and we want to be set free. >> stan green says b.a.r.t. workers should not be allowed to walk off the job because too many people rely on the trains. green also says he supports a petition started by steve glacier that would ban city workers from striking. stay with ktvu for continuing coverage on the possible strike. if there is a strike or if a decision comes down overnight, we'll be on the air at 4:30 a.m. in the morning. you can get updates at ktvu.com as well as facebook and twitter. eight student who attended a san jose charter school are being held back a year because their credits won't transfer. the mercury news reports students who attended a charter high have been told the

campbell union school district will not grant any credits for their work, even p.e. the charter closed the doors in june. students who transferred to school districts other than campbell's have been awarded full or partial credit for their classes. conservative groups are trying to repeal a new state law protecting transgender students. opponents are hoping to gather more than 500,000 signatures by november to keep it from taking effect this january. they've also hired a veteran gop strategist behind prop 8. governor brown signed legislation in august that would require schools to allow transgender students to use bathrooms and locker rooms for their expressed gender. over the weekend, governor brown vetoed 30 bills including one that would have attended the statute of limitations for victims of sexual abuse. the bill allowed those adults sexually abused as chirn to file lawsuits in court against

their accusers. the governor says over time evidence is loss, memories fade, key witnesses die or move away. governor brown vetoed a bill from mark le know. that bill gave prosecutions the option of reducing heroin around possession charges from a felony to a misdemeanor. 7:37. b.a.r.t. trains are running for now. at the top of the hour, we'll have a live report to see if it looks like they are close to a deal to avoid a strike tomorrow. a warning for students and teachers at uc berkeley. what happened that could be putting your safety at risk? we're looking good on westbound 24, a route that usually has more traffic. still a little more crowded in some spots. the weather is looking pretty good now unless you are looking for rain. this week looks sunny and warm. the lows are cold. we'll have more details coming up.

stocks opening lower on wall street after a breakdown in budget talks in d.c. with investors growing increasingly skittish about the possibility of a strike. bonds are closed for columbus day. stocks are open. the dow is currently down 69. the narc is down 12 -- the nasdaq is down 12. s&p down 7. 7:41. netflix is reportedly in talks with several cable tv companies. the los gatos company is offering to make its streaming video surface available through seton boxes. the paper reports negotiations are in the early stages and no deal is expected in the near

future. two european cable companies recently reached similar deals with netflix. we're paying less for gasoline as crude oil prices slipped. aaa reports san francisco has the highest local price at 3.92. south bay drivers are paying the lowest at 3.80. prices have dropped a nickel in the past week. what do i do? >> the space movie "gravity" continues to hold down the top movie at the box. it landed in the top spot for the second week in ta row. captain -- in a row. "captain phillips" opened in second place. a warning for people on around around the uc berkeley campus. pam cook is in the newsroom with a recent crime that seems to be part of a growing trend. >> yes, it is. uc berkeley police warning

students and faculty to be on alert after two women were robbed on campus. now, the robberies happened last week. the first near the beverly clearly housing building just before 8:00 thursday night. the victim says the robber took her cell phone. the other happened on berkeley way and oxford street. that was about 5:30 that morning where a woman says a gunman took her purse. now, uc berkeley police describe the incidents as a strong armed robbery and a robbery and assault. the suspect in the first robbery described the african- american about 19 years old, 5'11" and about 170 pounds. the second suspect, also described as african-american, 30 to 35 years old, about 5'10", and 150 pounds. now, anyone with information is asked to call berkeley police or uc berkeley police. now, berkeley police also say smartphone robberies of people walking alone at night are up 35% so far this year.

hostage. it's still unclear who is responsible for the yab -- abductions. kidnappings have become increasingly common in syria's kifl war. an american soldier has been killed in afghanistan. he died when a man wearing an afghan security forces uniform opened fire on the paktika priv vince. the shooting came a day after karzai and john kerry announced they reached a tentative deal to keep some american groups in afghanistan beyond next year. when the nato combat mission ends. they've agreed to keep american troops there. this was after two days of talks between kerry and the afghan president. they announced they've agreed on key elements to the deal that would keep u.s. troops in afghanistanant international forces pull out next year. there are still a few issues yet to be worked out such as whether or not american soldiers will have immunity. 7:45. and supporters of urban farming have stepped up their push to

preserve a plot of land that uc berkeley owns in albany. dozens of people gathered at the guild tract is share ideas and hear discussions about how to preserve the land for farming. this is used by agricultural researchers with part of it slated for a grocery store and senior housing. the library that's been opened for more than four months will be closed. the new and improved downtown lie prayerly will -- library will open on november 2nd. it will include a space for teenagers, upgraded technology and expanded children's rooms. san carlos residents are encouraged to use other branches during the time this closes and the downtown library opens. b.a.r.t. trains are at least running. and it's lighter today, sal, because of the columbus day.

police had to pepper spray to disperse a group of college students in bellingham, washington, after a house party led to a riot.

the incident happened near the campus of western washington university, when officers tried to break up the party, students began to throw bottles and yelled at officers. at least three people were arrested. no one, though, was seriously injured. animal rights activists are using more aggressive tactics to protect bears at lake tahoe. according to the "sacramento bee" members of the bear league have been keeping around-the- -clock vigils for a trap set by wardens and used pine sol on traps to keep the bears. they say bears are misunderstood creatures and should be left acone -- left hey -- left alone. last month, aldon smith was arrested on dui. two days laterrer, he took a voluntary leave of absence to undergo treatment at a rehab facility. he faces three felonies of illegal possession of an assault weaponing stemming from a party at his home. the 9ers hope he will benefit

from the help he receives at rehab. new research from stanford suggests a link from a chemical used in food. bp is used in many plastics and food lining. now a study shows high levels of bp could increase the chances of a miscarriage in women prone to miss carriages or for those having trouble getting pregnant. bp can have hormone-like effects. experts say the study does not prove a link. power has been fully restored to all buildings at uc berkeley following an explosion that damaged underground power lines. 11 buildings were unable to connect to the power grid after last month's explosion near california hall. most buildings were able to connect to portable generators until the repairs were finished. one student was hospitalized in the explosion which forced a campus-wide evacuation and the school to declare a state of emergency. a registered sex offender

has been arrested in santa rosa after police say he exposed himself to children. police say james canada approached a group of children on polk street yesterday and started touching himself inappropriately. officers found him hinding in the backyard of a home. he was arrested on indecent exposure and a parole violation. the cupertino city council is scheduled to hold a vote on plans for apple's new headquarters. those plans call for apple's new campus to be 80% open space, surrounding a space ship- like building in the center. they say this will encourage collaboration. the campus will be home to eventually 7,000 fruit, oak and olive trees as well. a final vote is expected next month. this morning, three americans were announced as the winners of the nobel prize for economics. the royal swedish academy of sciences named eugene fama and lars peter hansen of the university of chicago and yale university's robert schiller as

here. give yourself some extra time. let's go back to the desk. >> thank you, sal. a possible b.a.r.t. strike has been avoided, at least for another day. b.a.r.t. unions say they will be backing a the barg -- back at the bargaining table. tara moriarty has more on why management may not be joining them. >> reporter: we think they probably will come because grace crunicon, the general manager, has said if you have any questions, feel free to ask us. they probably have to be here in case the unions have some questions that they need to ask them. but again, it's no guarantee. let's take a look at video that we have from last night. the union leaders are frustrated, very tired. they agreed to put off a strike for a day to extend negotiations and despite the gag order, b.a.r.t. eight general manager announce -- b.a.r.t. eight general manager announced the deal, it gives the raise of 3% for four years and it

requires a 4% medical pension contribution. and nearly a 10% 10% contribution. >> they yanked the oster at the -- offer at the last minute. that's an indication of they were no longer willing to bargain. >> it's time to bring this to a close. bay area is tired of going to bed at night and wonder if there will be a strike. >> reporter: she says the offer expires in two weeks and then the union can ask questions. state lawmakers are not pleased that b.a.r.t. has said this is the best and final. they indicated that both sides seemed further apart. by midnight, workers could go on strike. both sides are supposed to reconvene at 10:00 a.m. we'll keep you updated and let you know if any deal has been

struck before that deadline at midnight. i'm tara moriarty, ktvu channel 2 news. >> thank you. 8:02. if there is a b.a.r.t. strike tomorrow, there are some commute alternatives but they are really not ideal, especially for commuters in the east bay who are not heading to san francisco. county connection will run a small number of buses between the concord b.a.r.t. station and the uptown oakland transit center. we'lls is also planning to -- wheels is also planning to run between the dublin pleasanton b.a.r.t. station and an undetermined east bay hub. b.a.r.t. will offer limited bus service to the transbay terminal in san francisco. b.a.r.t. will charter about 200 buses for the morning and evening commutes in and out of the city. commuters can catch a bus at nine stations including el cerrito, west oakland, concord, walnut creek, la fayette, dublin pleasanton, san leandro, hayward and fremont. >> it was actually -- i was

actually hitchhiking. >> reporter: are you serious? >> yes. no lie. i was actually hitchhiking to work. >> to -- hitchhiking to work. if b.a.r.t. strikes, a.c. transit would increase service. bus stations inside b.a.r.t. stations would be moved to streets outside of the stations to avoid any confronttations. the ferry is on regular service today. the san francisco bay ferry transported more than 19,000 commuters a day during the strike back in july. that's more than three times its normal average of 6,000 passengers. carpool hours will be expended from 5:00 a.m. to 7:00 p.m. on parts of i-80, 680 and 880. all bay area toll brinks as well if there's a strike. carpooling is available at many locations including east bay b.a.r.t. stations. for a full list of locations go to ktvu.com.

says that pales in comparison of tourist revenue that they were losing when it was closed. there was a dry ice explosion at l.a.x. an explosion happened in terminal 2 in a bathroom. that bathroom is in a restricted area not accessible to the public. they say the dry ice was inside a plastic bottle. the explosion temporarily stopped security screening and four departing flights were delayed. no injuries were reported. new screenings for security are in place at oakland airport today. a tsa precheck program allows some passengers to keep their shoes and jackets on when going through security. they also do not need to remove laptops from the cases. the program which cost about $100 to join is available to select frequent flyers and members of the u.s. customs and boarder entry program. so far the prechecked lane is

only available in terminal 1. it will be expanded to terminal 2 by the end of the year. a former san jose teacher accused of sexual misconduct is suing a group of parents. contra costa times reports the family has accused john fishler of inappropriately dauching their daughter at the school where he taught school. he's suing the parents. students who worry about how their social media postings might affect getting into their college of choice can relax. according to the admissions officers interviewed by the san francisco "chronicle", they don't usually check the social media in evaluating students. many students say they would consider this an invasion of privacy. they also say given the number of applicants it would be impossible to research everyone. let's check in with sal.

good morning, everybody. welcome back to "mornings on 2." you are looking at live pictures from the pleasant hill b.a.r.t. station where the monday morning commute is underway on this columbus day. b.a.r.t. trains are running after the deadline was postponed until midnight tonight. coming up, how commuters are feeling about the latest development -- coming up in a live report. i'm brian flores. dave clark has the day off. let's get your day started with weather and traffic. steve paulson looking very stylish this morning. thank you, sir. we have very stylish weather as well if you like sunshine and warper temperature -- warmer temperatures. people are asking me where is the rain. don't see any.

you know it will probably rain on halloween. sunny and warm by noon. maybe. 30s on the coast. very low 40s. temperatures are starting to bounce off some of the morning lows. rather brisk lows. 21 up in tahoe. 41 ukiah. 35 up in clearlake. a little chilly there. but it will be sunny and nice. hardly a cloud low or high in the entire state. night weather on tap -- nice weather on tap. severe clear. there is a slight component of an easterly breeze. as you know, the nights are getting long. the days are et going shorter -- are getting shorter. here's sal. steve, good morning. we're looking at traffic that's been lighter today. but i hope it's not a -- not the calm before the traffic storm. let's take a look at the bay bridge. it really has been pretty good getting into san francisco. the delay has been gone for the past hour. moving along and taking a look at the commute here, if you are driving on interstate 880, it's not a bad commute at all.

i do want to mention that traffic in the east bay is completely improving. we had a backup here in this area. but now there's only a little bit of one right there, just to make it simple for you to see it. the traffic is getting better even here. let's go back to the desk. >> thank you. we're following developing news out of san francisco this morning, where the search is on for the person who shot and killed a man. ktvu channel 2 reporter katie utehs is live at the scene with more on questions police still have in their investigation. katie? >> reporter: brian, police have been on scene for hours. from what we can see now it's daylight, it appears the evidence markers for the bullet casings were further down bartlett, closer to 21st street, the man's body came to rest in the middle of the street closer to me, on 21st. when we arrived at 6:00, the street was very dark. let me show you video. the call came in around 4:30

this morning that someone had heard four to five shots in the neighborhood. police say when officers arrived on scene, they performed cpr but the gunshot victim died in the street. i'm told police don't have any witnesses or a description of the shooter. they only said the shooting victim in an ma. neighbors say -- is a man. neighbors say hearing gunshots is common and they are not surprised. >> it has not happened in a while. it used to be a regular thing around here. i grew up in this neighborhood. >> reporter: the medical examiner removed the man's body around 7:00. for the last hour or so, police have collected more evidence. they've also canvassed the neighborhood, again, looking for any witnesses. again, at this point, the shooter has fled the scene and police do not have a description of who -- what that shooter may look like. there are construction workers here that are being tied up. as we go back out live, you can see this area behind us on bartlett is a construction

site. they are building condos. these workers are being held up. it may be another hour or so. police are unsure exactly when this stretch of road will reopen. live in san francisco, katie utehs, ktvu channel 2 news. richmond police are investigating a deadly shooting. police say at 5:30 last night, shots were exchanged between two cars. one of those cars crashed a few blocks away on ohio and south 7th streets. police say the driver of the car died at the scene. we have calls into richmond police for suspect or vehicle information but have not yet heard back. 8:34. b.a.r.t. trains are running today. but b.a.r.t. workers say they could go on strike tomorrow if a deal is not reached by midnight. that's left b.a.r.t. riders in limbo, wondering if they will have a ride to work. ktvu's cara lui is live with what lied riders are saying -- with what riders are saying. >> reporter: good morning. we've heard a lot of

frustration out here from riders not sure how to plan for tomorrow. several people we talked to here say traffic during the monday morning commute seems slower than usual. likely due to the holiday. many folks are making alternate plans to get to work today. quite a few riders are fed up with the possibility of another strike. a few sympathize. many want to know they can count on work to get to and from work tomorrow or wherever they need to go. >> just make a decision. everyone is struggling. you have to compromise. >> i work for the fel so i em-- federal government so i emphasize with the workers. at the same time, it's inconveniencing a lot of people. it's causing little lifts in everyone -- rifts in everyone's daily routines. >> it's very inconvenient. i got up early this morning not sure if i was taking the ferry or b.a.r.t. >> reporter: we haven't heard back from b.a.r.t. as to whether they expect volume to be down tud. but a -- today.

but a spokesperson says ridership was down on friday by 20,000 passengers. cara lui, ktvu channel 2 news. >> thank you, cara. 8:35. in case of a strike, b.a.r.t. says managers could operate some trains but only as a last resort. a b.a.r.t. spokeswoman says that would happen only if a strike goes on for a long period of time and it would require board approval. there are about a toz managers trained -- dozen managers trained to operate trains. union officials say that plan would endanger passenger safety. union workers are giving b.a.r.t. management until midnight to come back to the table to hammer out a deal. it doesn't sound like management will be there. coming up, the best and offer final from b.a.r.t. and why the unions say it's not good enough. students at a san jose charter school are being held back a year because their credits won't transfer. students who attended a charter

high have been told the campbell union school district won't grant their credits for their work even in p.e. the charter high closed the doors back in school in june. students who transferred to school districts other than campbell have been awarded full or partial credit for classes. groups are trying to repeal a new state law protecting transgender students. opponents are hoping to gather more than 500,000 students to keep it from taking effect in january. they hired a gop strategist behind prop 8. governor brown signed legislation in august that would allow schools to allow transgenders to use restrooms, for transjnders. the 49ers are not counting on aldon smith returning to the team. last year he was arrested on dui. and then he took a voluntary leave to undergo retab treatment.

he faces three felony charms of an assault weapon stemming from a party from his home. the niners hope he will get the help he needs at the retab. a registered sex offender has been arrested after police say he exposed himself to children. police say james canada approached a group of children on polk street and started to touch himself inappropriately. officers found him hiding in the backyard of a home after conducting a search with police dogs. he was arrested on suspicion of indecent exposure and a parole violation. the cupertino city council is scheduled to hold a vote on plans for apple's new headquarters. that calls for the campus to be 80% open space with a surrounding space ship like space. this will encourage collaboration. the campus will be home to 7,000 fruit, oak and olive trees as well. the final vote on the project is expected by next month. it is 8:38. new concerns about a chemical

stocks lower on wall street after a breakdown in budget talks brought the nation closer to a potentially dangerous default. coca-cola, johnson and johnson report their votes tomorrow. bonds are closed due to columbus day. but the stock markets are open. the dow is down 38. the nasdaq is down 3. s&p down 4. 8:42. let's get you updated on some of the top stories we're following right now -- police in san francisco are looking for the suspect of a deadly shooting. it happened a few hours ago on 21st and bartlett street. police say witnesses report hearing four to five ubt gunshots. when -- five gunshots. when police arrived, they found the man lying in the street. the annual pumpkin weigh-in is going on right now. there are awards for the

heaviest and the prettiest pumpkins. the b.a.r.t. strike deadline has been extended until midnight. trains are running. union leaders plan to head back to the table at 10:30 this morning. tara moriarty has more on the deal b.a.r.t. management presented yesterday that they call is the last and final and how the union is responding. tara? >> reporter: well, union leaders emerged from the building here at caltrans headquarters at 2:45 a.m. they were tired and frustrated. they say they are angry because they feel that these talks have slowed to a halt. they did agree to put the strike off for one day while these negotiations continue. despite the gag order in effect, b.a.r.t.'s merck announced the deal she's offering workers that gives employees a 3% pay raise per year for four years. it requires them to make a 4% pension contribution and a nearly so% -- so% -- 10% medical cpt contribution.

>> we'll be -- we'll be here tomorrow morning to be ready to negotiate. we hope the district will take that as seriously as we are. >> we've given them two weeks to consider the offer, take it to a vote to the to the members. i hope they will take it ear justly and look -- seriously and look at it. we're open to any ideas they might have. >> reporter: the offer expires in two weeks. in the meantime, unions can freel to ask her any questions about the offer. state lawmakers are not pleased that b.a.r.t. has said this is the final offer. while they are happy the strike was avoided for today, they indicated that both sides really seemed kind of far apart. and nid -- sod a mid -- sod a -- so at midnight there could be a strike. tara moriarty, ktvu channel 2 news. a martinez man is so frustrated by the threat of a strike he's been picketing outside of the negotiations. >> we're being held hostage by the unions at this point.

5'11" and about 1 p 0 pounds. the -- 170 pounds. the second suspect, also african-american, 30, 35, about 5'10" and about 150 pounds. anyone with information about these crimes is asked to call police. new research from standard suggests a possible link between a chemical used in some food processing and the risk of miscarriages. bpa is used in many plastics and canned food linings. now a study shows high levels of bpa could increase the chances of a miscarriage in women prone to miscarriages or who have trouble getting pregnant. bpa can have weak, hormone-like effects. experts say the study does not prove a link but adds evidence that bpa could affect fertility. you may be able to blame the sun for those dropped calls 0 your -- calls on your cell

phone. researchers in hawaii say the solar rays are so intense they drop calls. it's the first time that the researchers have made a direct connection between solar storms and dropped calls. they say this can affect gps favgation and even -- navigation and even cause power outages. more than 100 people have been killed during a hindu festival in india. some were crushed to educate after a -- to death after a stampede on a bridge where a pilgrimage was held. british police have released two computer images in the disappearance of a girl in 2007. the images show a white man between 20 and 40 with short hair. several witnesses say they spotted him in the resort in portugal on the evening madeleine mccann disappeared. >> these fits are clear. i would ask the public to look

westbound -- bridge here, westbound. taking a look at 880, normally at this time, we have a slowdown but some people are off today. moving along to the lirl valley, i keep watching -- livermore valley, i keep watching this because it looks better when we come to it. that's a sign things are getting better. let's go to steve. clear skies, sunshine across the board for everybody. it looks like it might be this way for everybody. it might get breezy tuesday night and wednesday. other than that, sunny skies and warmer. getting tough to warm up that much. we'll be warmer here. high pressure kicks in. you combine that at the surface. not much of a breeze now. there might be again in the next day or two. 70 to near 80. fire danger will go up a little bit. the system will dig into nevada. that will crank up the breeze. we won't get anything out of it overall, clear skies almost all the way down to southern california. it was told cold this morning. had 30s and 40s. now we're starting to see warmer conditions. but again, the nights are getting longer. that cold air has more of a chance to settle in.

if we have calm conditions, it's easy to get in. sunshine, breezy and warmer. any breeze will hold some of the lows up. we'll see if that translates. warmer pattern takes us into wednesday and then i think we keep it there. looks quiet. 70s on the temperatures here. a few 60s near the beaches. not that big of a difference here. maybe 10, 12 degrees at the coolest, to the warmert -- warmest. everybody will be close. a lot depends on if the east breeze kicks in. if it does, the coast will warm up. a lot of the 70s here. breezy, warmer. slight warmup tuesday into wednesday. i think we level it off thursday and friday. everything continues to go as tared. it looks sunny, mild, warm all the way into the weekend. nine minutes before 9:00 -- protecting wildlife in lake tahoe. the length some people are going to so bears won't end up in traps.

8:54. animal rights eighths are a -- activists are using more aggressive tactics to protect bears at lake tahoe. members of the bear league have been keeping round the clock vig yiles of traps set by game wardens. they are using pine sol on traps to keep the bears away. they say bears are misunderstood creatures and should be left allen? the city of oakland will continue the fight to keep the proteams from leaving. they are set to discuss a

coliseum for the raiders, as and the warriors. city officials are hopeful because some investment firms with deep pockets are reportedly interested. power has been fully restored to uc berkeley following an explosion that damaged underground power lines. 11 buildings were unable to connect to the power grid after last month's explosion near california hall. most buildings were able to connect to portable generators until the repairs were finished. one student was hospitalized in the explosion which forced a campus wide evacuation and the school to declare a state of emergency. schools in palo alto are trying to figure out what will happen when stanford opens more than 200 new housing units. stanford plans to open the new housing for faculty in 2016. that means more school-aged children will need places to go to school. the school district is trying to figure out if it needs to redraw school boundaries since the schools closest to stanford already have some of the largest enrollments. this week, thousands of

students in vallejo will get some badly-needed school supplies. the vallejo education association is holding its fifth annual helping hands event. it will give away 2,000 bags of notebooks, pens and other school necessities. today supplies will be handed out between 3:00 and 6:00 p.m. at the omega boys and girls club. there's another one tomorrow at the sprigestown lie -- springstown lie prairie and the students need to bring the flier they were given from the school. let's go to sal again. how are things in the south bay? >> it's still a little slow there. i think people are getting their late today. it's slow here. we had an earlier crash, northboundle 80 at -- northbound 880 at brokaw. but 101 and 280 are looking not that bad. the bay bridgetop looks -- the
